    I made the point several time before on this company being insolvent as far back as 2007.

    Section 95A of the Corporations Act provides a definition alongside section 588G of the same Act amongst other provisions of the Act and other related acts we believe the comnay has breached with impunity over the years.

    The question remains as to why ASIC has failed to act on any complaint or at least on their own initiative considering the widest possible publicity from within the company and from analysts, the company's directors, journalists and influential journals and the company's record loss of about 90% of its market capitalisation over a relatively short period of time.

    Babcock and Brown is insolvent by its own admission and its inability to have provided conclusive proof to the public that arrangements it is purported to have netered into with banks and its creditors have been binding commitments to this effect.

    There needs to be further investigation into what this company really is about and who it has compromised along the way from its legal advisors and government officials to the extent that no one from either of these sectors show a willingness to bring this company and its board to book.
