It would not be unreasonable to assume now that the longer it goes on without the deal being ratified, the less likely it is that it will be sealed.
it also could not be unreasonable to assume that the longer the wait the more likely that the two parties are coming to a consensus and an agreement... So I reject your presupposition here. They are likely planning a proposition to the FDA, planning out confirmatory trial, budgeting resources....
