If anything NHC have been tolerant of Oakley, allowing the association, which is really just a front, to accrue $750K in liability for legal actions they clearly could never afford. At some stage shareholders may need to ask whether NHC management was too tolerant, exposing them to costs that (it appears) will never be recouped and possibly inviting litigation that was always doomed to fail. Let's be honest, NHC isn't a charity and Oakley doesn't represent the community. In this country, if you litigate you do so at the risk of covering the other party's costs should you fail. Why should Oakley be different?
