I agree it is highly likely we will be successful tomorrow. However, as day follows night, I also think it is highly likely they will take it back to Court again and seek to quash the Minsiter's decision on the grounds it was not lawful and therefore invalid (which, they would argue means that the court ouster section in the AEL Act does not apply). I can already see some arguments that I think they are likely to try (though I wont be offering them up here for their consumption). Depite this, even if they immediately go to Court, I cannot see it stopping the issue of the TOL either tomorrow or later this week. Even if they were to get the Minister's decision set aside (which I think is possible) that would not invalidate the issue of the TOL because the decision of the AELB would still stand. They would be futilely handing out their supporter's moneys to lawyers, gradually alienating their supporters.
