agj26 I wouldn't think that development agreements with 3M or Hovion would complicate matters ... there's nothing happening with them because of lack of funding. They are on hold and like us looking for a deal. We have a patent Granted 2009 expiring 2025 for nadolol ( asthma, titration, dosage) US7528175, we have patents applications pending in copd US12/436051 expiring 2024 and smoking cessation US10/574677 expiring 2032. Our patents look sound and have not been challenged. I believe Dr Bonds invention passes the test of non obvious to those in the skilled art ( but I am not a patent lawyer) Big pharma have rightly been jittery since the Mayo v Prothemeus decision of the US Supreme court in 2012 which came down heavily against patenting dosing . ( IMO it went too far ).
This decision is now being appealed in the Federal circuit court which actually has jurisdiction on patent law.
Nadolol is a generic, but has a propriety dosing and delivery/titration patent that to date hasn't been challenged through a FDA patent reexamination or lawsuits( a very expensive exercise ).
IMO Invion has something of real value and big pharma's only concern is patent life and protection from generics. The inhaled program slam dunks this because it differentiates a generic drug with a highly specialized titration system with a unique mode of delivery. 3 M and Hovion this is where you make your money.
