You both have different opinions of what constitutes a 'gap' due to a fundamental difference of opinion when it comes to charting.
aCouch's View:
As long as the bar of the previous day's trading covers any 'gap' in the open price of the following day, in his opinion there is no 'gap' as there was an opportunity for trades to occur at that value.
Slick's View:
If there is no continuity between the previous day's close and the following day's open, that constitutes a 'gap'.
You have fundamentally different views on what constitutes a 'gap' while looking at the same data - if I give you both an identical chart you'll each see gaps at different prices due to this fundamental difference in opinion.
