I noted that the July assertion Portfolio Update was just a rehash of the February Update except for the fact that Seimens/DT are now disputing the infringement claim which was based on the original patent and not the modified version. One aspect that has been left out of the update is how significant those modifications are with respect to the overall claim.

Alarm bells rang for me when I read " If the Court dismisses the infringement proceedings, QPSX Europe GmbH will consider whether to re-file the amended complaint in a new proceeding"

To my understanding the whole Ipernica/QPSX existance for the past 6-8 years has been based on what I accepted to be a protracted yet virtually guaranteed outcome for the DT & S case and now we are considering whether we will even proceed with the litigation?.....surely that cannot be possible.
