So I have read the entire Class action as posted here. The verbiage used in the Anns. have been ' If - May - potential Etc, Hardly stating a preconceived outcome in regards to FDA. So what you have suggested is that there has been further information that the company (MSB) perhaps should of disclosed and didn't. Is this right? It seems to me that the class action is indicating that the past trails (the early test results) should of been included in Ann. And because they were not an investor did not have complete information in which to make an informed investment decision.

Love your thoughts here, I'm just trying to understand how this could be an issue when deciding to invest as the FDA did put out concerns to the ODAC before the meeting. This was public information and easily accessible. I was concerned when I read this from FDA. But felt that the concerns where asked and answered. Totally MO and felt satisfied by the 9-1 vote.

Anyways would love to hear more from you on this.
