Regardless of who gets the primeministership, 76 members have to vote for a mining tax. Labour now has 74, Katter says he won't so both Oakshott and Windsor have to vote for it to get it through. They may support Gillard for PM but I would be willing to bet (and I have by not selling my shares) that one of them won't vote for the mining tax
