Liminar prevents resuming of Brucutu mine on schedule, Vale notes

SÃO PAULO - Vale announced today that Brucutu mine operations will not be resumed within the deadline estimated last Thursday, when the company received from the State Secretariat of Environment and Sustainable Development of the State of Minas Gerais (Semad) the provisional authorization to operate (APO) of the Laranjeiras dam.
The statement was made after the Single Court of the County of Santa Barbara issued preliminary injunctions on Friday, which determined, among other points, the paralysis of activities of the containment structures Dam Paracatu Containment Dam; Blue Lavra Containment Ditch; Dicão Leste Dam; Mosquito Dam; Containment Ditch Cobras; South Dam; Dam Sabiá; B3; Dike of the São Gonçalo Road; Main Dam; Dam Captation; Barrage Piggery and Dam Athayde.
On the 19th, the 1st Public Treasury Court and Municipalities of Belo Horizonte authorized the resumption of activities of the Laranjeiras dam and the Brucutu mining complex, with Semad releasing activities on Thursday. The estimate was that operations would resume within 72 hours.
According to Vale, the decisions of the Single Rod of the Santa Barbara County will impact only Brucutu operations, as the South Dam receives occasional discharges from its concentration plant. The decision will have an annualized negative effect on the company's total iron ore production of approximately 30 million tons.
The miner said it was aware of the decisions but has not yet been notified. According to her, the injunctions were based mainly on a notification received by the Minas Gerais Public Prosecutor's Office, which presented the public civil actions that resulted in the shutdowns, containing preliminary information on the structures.
"Vale will continue to take all necessary measures to ensure the safety of its dams and will take appropriate legal action in the context of lawsuits," the statement said.
