It's all about intent. Eg if you sell to crystallise the capital loss and rebuy immediately it's a wash sale.
if you sell because it's a good time to sell and you rebuy cause it's cheaper etc and you can prove you weren't doing it solely for crystallising the loss you're all good.
tbh I think it would be hard for the ato to prove but certainly am not reccomending!
