If I were a holder I would be transferring them to the jab trust or selling them to jim. A supreme court judgement would at least give you comfort that you would be unlikely to be charged with fraud. At worst the transfer would be reversed. Why wouldn't someone want to try this.

Imo, it is clearly the intention of BCS and its friends to dissuade distressed unit holders to transfer their units, and I suspect that they will employ any safe means by which they might achieve such an end.

Own these on the 29th and you are meat for slaughter. Dont think these people will spare a unit holder who cannot pay.
