Accused of breaking the deal it made with the owners of the Djiffere block, FAR will only accept the jurisdiction of British courts to rule the case.
Australian junior FAR is treating British firm Cap Energy's court case against it as simply null and void. The two companies, who teamed up on the offshore Djiffere block, are at loggerheads over the seismic data for the permit.
First of all, FAR feels that Senegal, the place of jurisdiction chosen by Cap does not have the authority to rule on the dispute between the two companies. According to FAR, given that the agreement signed with Cap for Djiffere was drawn up in compliance with British law, that is where the dispute must be settled. Signed in September 2015 between FAR and Trace Altantic Oil (Djiffere) Ltd (TAOD), the joint venture between Cap and Trace Atlantic Oil, the agreement gave FAR the right to acquire 75% of Djiffere after having carried out a 3D seismic survey of the concession to ascertain its potential (AEI 754). For FAR this was a means to extend its concessions in Senegal. The firm already holds permits Sangomar and Sangomar Deep near Rufisque.
According to Cap, under the agreement FAR was required to share the 3D seismic findings with TAOD. Not having access to the data, Cap asked the first court covering the case in Dakar to temporarily seize $3.5 million on FAR's accounts, $1.5 million of which corresponds to the seismic survey. FAR, which needs cash to fund work on its Senegalese permits and on blocks A2 and A5 in Gambia (AEI 797), would be hampered if any of its accounts were seized. For its part, the Australian firm claims that, besides the fact that the survey findings are still being analysed, none of the agreement conditions require it to disclose these to TAOD. This would make Cap's complaint ungrounded. Furthermore, FAR claims it was not informed of the complaint on July 19, while Cap confirms that a notice was published by the Dakar city council. While FAR fears that the Senegalese government ordered TAOD to pay $15 million without with the permit will be suspended, Cap has stated that it has until July 2018 to drill a well on the concession.
