    gambier33 you said "Substantially commenced" has been defined endlessly in common law. - not a term used often - if at all - in common law more likely in contract law !

    And AS4000 contains a list of definitions that mostly likely would cover this. However Lawyers can always argue black is white etc... so it would proceed through the courts for many years and multi $$$ before an answer was had.
    The advice I have is that these projects don't often stall due to planning deadlines as 'substantially commenced' could in fact be argued even if a single sod of earth hadn't been dug - its a red herring - its more likely the project will fall at the finance hurdle.
