there is a great big court case currently goin on between isx and asx ...... seems a pretty obvious question to me to clear things up ........ did isx ask about that during discovery and statements of claim and stuff ??

perhaps they forgot ?? .......... dunno...... prioritized the more important stuff perhaps ??
