is mitsu breaching their contract

Glyna do you have the announcement regarding the mitsu /MMX deal. I thought Mitsu had to pay the second payment on the release of the feaseability document and if the amount couldnt be agreed it was to be decide by an arbitrator who,s decision would be final .I believe this payment was payable even if the venture didnt proceed .after all you dont buy a car put a deposit down then dont pay the balance ,because you later decide you dont like the deal, also wasnt mitsu responsible for the financing and providing shortfall finance to MMX ,Puntman Pre Float investor
