Thanks for the find, it was an interesting read. In summary, there is uncertainty regarding the likelihood and severity of impacts that may arise from fugitive groundwater contamination on habitats for listed threatened and migratory species.

This issue is required to be addressed within the Environmental Impact Statement (EIS) under Division 6 of Part 9 of the EPBC Act. So, what would be the next steps? I tried looking for Division 6 of Part 9 of the EPBC Act (https://www.legislation.gov.au/C2004A00485/latest/downloads), but it doesn't seem to exist. However, there is a Part 8, Division 6 for EIS, stating that the Minister must supply EIS guidelines within 20 business days from the decision date, which was 16 November 2023.

I presume if the guidelines are not already with NRZ, they would be shortly. Additionally, it is worth considering whether they have the funds to carry out the required work. I would love to hear how they plan to move forward. It also makes me think that the withdrawal in 2021 was due to the inability to address the issue, or they thought there was another path to avoid it. Either way, it has come back to bite them."
