Two reasons, because:
1. ASIC is the regulating body that is suppose to monitor ASX and any perceived conflict of interest, and
2. We don't know the nature anyway of ASIC's investigation except that it wasn't serious enough to warrant asking for ISX to be put on suspension. What we DO know is that ISX has asked for an AFSL which would require ASIC and APRA and ??? to investigate before providing ISX with this license.
