I am not quite sure how to interpret this: but want to make it clear they are not being sued for $40m in damages of any sought. They are being sued as a timing issue around a $40m payment that is sue and payable when 25000 tonnes of coal is "shipped" from the escarpment.
I just take issue with the word "material" for an amount that is owed without dispute. It is only the timing of the payment that is in dispute. Now would be a better time to raise the funds than 12 months ago and many of us believe not as good a time as 12 months hence.
Perhaps the timing is material, The amount is definitely not in my mind
