Palestine can't argue cases before the ICJ - you need member country status to do that and Palestine are only observers... the best they could ever hope for would be a war crimes trial at the International Criminal Court, but seeing as though are purposefully targeting civilians themselves I'm not sure they would try mounting what would be an unwinnable case.
