Been just chillin since the judgement reading posts.
Haven't even comment on the Court Judgement. It just worked out that way, the posts post the judgement were so spot on about isx winning the majority of the case there was no need to add anything.
Yes asic won a few points. However those points carried less weight or impact than the main prize of the performance shares issue = all the charges aren't ranked equal. The performance shares carried 70% of the points on offer imo, and were the only charges that could have had major implications for JK and the company if it went against them. So at fulltime the final score was ISX 70 v ASIC 30 If you look at it like a football scorecard if that helps you to see the relevance of asic result. Anyone seeing a final score of 70 to 30 can easily see isx won what mattered in this trial and asic lost the most important point and therefore the most weighted point contested = the 70/30 result.
You also know asic lost the large majority of the case when the AFR & media outlets did the most basic coverage of the judgement. If it went the other way and asic won the main prize, the media would have been screaming for a week, rehasing everything, really going to town on JK and the company.

And there's the huge difference in each parties action.... isx caused relatively no harm to shareholders, were ASIC / ISX actions caused major harm - JK 's 15% quote had zero impact because everyone had the same info = everyone was on the same playing field = no one benefited from the quote. The visa issue was used to keep the suspension going. If you remember isx had passed all the asx flaming hoops and hurdles, and asx were compelled to readmit the company to trading before all of a sudden this visa issue arrived.... who could have predicted this happening lol.
Anyway the shows over at last. The desired results of the system have been acheived. The claytons charges were only the excuse for their actions.
