    I don’t think this is the case from my perspective.

    looks to me as if ISX got what they wanted from the Visa subpoena scenario. That is, a true and accurate representation of the information flow between parties as sworn by a visa representative. This would be cross examined in court.

    I don’t know everything about the court system but I guess if the information in the consent orders is false, that would spell trouble for Visa and we wouldn’t see an award for costs given Visas way if the information was false.

    Remembering back to when this all played out, there was no way ASIC could have legally obtained the documents and data they got through a Visa entity ISX did not do business with.

    The $150k would be well spent from my perspective.
