Maybe. It wouldn't be a good look and I'm sure the trial Judge would have something to say if a ruling went against ASIC. But ISX has to prove any illegality first. Illegally obtained evidence can be admitted following a voir dire. It can be excluded also. Have a look at the section 138 of the Evidence Act.
