You can't sell shares held in escrow using the standard ASX escrow agreement - either on market or off market until the escrow period expires or they are otherwise released from escrow.

JK et al could sell the performance shares off market now if they could find a buyer willing to pay their price, and accept their risk.

And what I mean by splitting hairs to suit a narative, is the desire to come up with any reason for the suspension and troubles ISX finds itself in, that IS NOT related to the perf shares. For instance, the dogmatic attempt to paint the circumstances ISX finds itself in being primarily caused by its potential to compete with Visa and/or ASX.
