    I think before we launch too far in, it should be noted that this is a 1995 article, so the legislation referred to such as the Corporations Law and the Securities Industry Act 1980 are long-since repealed and have been replaced by the Corporations Act 2001 (Cth) and the ASIC Act 2001 (Cth). It's then a question of seeing which sections were carried over into, relevantly, the new Corps Act and to what extent. The rule of thumb is always that the Act overrides the rules otherwise it's the tail wagging the dog. There's no question that there can be judicial review of administrative decisions and ISX has pleaded that. The common law principles of judicial review are applicable to whatever legislation it is that they have to address.

    Some of the provisions below may be of interest, esp. insofar as the ASX failure to disclose certain matters.
