You quoted the reference completely wrong.

The case would have arisen if ASX didn’t enforce the listing rules per se not suspending the ISX (If ASX suspects ISX has breached the listing rules), then (a) to (d) above may make an application to court to demand ASX enforce the listing rules that is ‘suspend the ISX from the official quotation’.

and "if ASX did not effect suspension, the ASX would be "aggrieved".'. ......... with the stress on "not" meaning that ASX would have been aggrieved.

I don't see where we are in disagreement @centro11.
