A4paper - this "sticking point" you refer to has created a $462m legal battle.
In Australia we have an expectation the business community will act lawfully and in a fair and reasonable manner. We expect an organisation with delegated (Govt) authority to also act lawfully and in a fair and reasonable manner.
Was it fair and reasonable for ASX to try and stop a potential competitor from releasing information to the market that rebutted the ASX viewpoint?
Was it a fair and reasonable for ASX to block the ISX response after the Court had allowed the release by ASX?
Was it a fair and reasonable for ASX to block a market release that effects 10,000 ISX shareholders?
Was it fair and reasonable for ASX to block the market release when ISX stated it would suffer damages if the SOR was released by ASX?
Was it fair and reasonable for ASX to not inform the stock market with a "price sensitive" information market release that it is being sued for $462 million.
