A far more interesting question is whether the uprampers can be sued. Anyone who made a "Boom! To the moon!" post on ISX when the share price was 20c or 30c, surely has a case to answer for the losses (as yet unrealised) suffered by anyone who bought as a result of reading that post and is now left holding. But those supporting the company only ever make strictly factual posts, amirite?
Academic, of course, when ISX wins its case against ASX, is paid enormous damages, and re-lists at $5 a share. Gosh, I am looking forward to that.
