AGS has stated that ITOCHU hadn't indicated whether they would take up their options, so obviously the deal is still in place. There is nothing in the announcements we have been given that indicates it was only on the condition that AGS regained 100% of the project.
It did say the funds recieved from ITOCHU would be used to build a standalone plant if that was the best option.
Obviously a standalone plant is not an option anymore but ITOCHU can still buy into the project if they want to.
If ITOCHU buy in now we are stuffed, unless they buy us out completely and pay a high price for the remaining 60%.
