Yes you're right gassed it was Beach who initiated court proceedings, but realistically, surely management didn't think they would just pack up their ball and go home. Knowing this and given ICN's unwillingness to fight it out in court I could only think that management were hoping to settle out of court and maybe get a better deal. To do this though you have to be bargaining from a position of strength, which they obviously weren't because as I said, the deal to me looks worse than the original (again I could be wrong).
