I think you are both grossly mistaken. Judicial review was not discussed yet and not decided yet. On Nov. 8 the judge plans to decide whether to allow Lynas to participate as an intervener and whether to go for Judicial review or not and if to go for JR whether to continue with the injunction on the TOL.
If she is unbiased she must remove the injunction even if she decides to go for JR. If she is biased then she will continue with the injunction and go for JR.
So, the whole question is: is she unbiased or not.
Another important question: If she upholds the injunction, is it possible at this stage to appeal to a higher court. I would like to ask Totolapse, resourced and rastus2 what do they think about this question.
