To me that still sounds like a judgement of merit is being made. IMHO. Who is a judge to decide what "credible" scientific evidence is. The judge can only decide wether a law has been transgressed, as mentioned above.
The AELB decides if any scientific evidence has credibility or not, the Atomic Energy Licensing Act 1984 (ACT 304) empowers the AELB to make those decisions.
