My expectation is the judges will look at the entirety on the tapes, documents and testimony to determine whether or not there was a serious attempt to overthrow an incoming US government.

They will likely consider:

- commentary by Trumpists

- the fake elector scheme

- arm twisting to falsify results.

- pressure on Pence not to certify.

- Communications from Congress collaborators on the location of Pelosi and other targets.

- Proud Boy testimony.

- The manner in which Team Trump wound up the crowd on J6.

- What the crowd did

- What Trump did and didn't do.

Judges and appeal judges will need to determine whether the combination of these actions constitutes an insurrection in the context of the 14th Amendment. This is only for ballot paper eligibility.

My expectation is that conservative SCOTUS judges would call a spade a spade.
