Public servants and private employees receive travel allowance for work matters. If any defrauded their employer to the tune of $40 or 100K, the matter would be referred to the DPP for prosecution. There should be zero difference for politicians. Having to pay it back when you're caught is not a punishment, merely an inconvenience.
