Public Contracts Update
Under the FAR at 31.205-18, Independent Research & Development ("IR & D") means a contractor's costs that consist of projects falling within the four following areas:
Basic Research Applied Research Development Systems and other concept formulation studies IR & D effort cannot include technical effort expended in developing and preparing technical data specifically to support submitting a bid or proposal. IR & D does not include the cost of efforts sponsored by a grant or required in the performance of a contract. Controversy continues over the exact meaning of the highlighted phrase. Under Department of Defense procurement policy and DCAA's view, effort specifically called out in the contract or "impliedly required" for performance of the work is excluded from the definition of IR & D and, hence, cannot be charged as an indirect expense but must be recovered directly under the contract or not at all. Industry's response has been that only costs expended for work specifically called out in the contract or paid for under the contract or required as a deliverable must be treated as a direct cost and not included in overhead as IR & D costs are.
