NAE would obviously be on notice as to the forthcoming EGM.
They should think long and hard about how they vote, if at all. ASIC will most certainly be watching every step including the possibility of rescinding the cross placement in due course.
The NAE directors should be rushing out to get good legal advice as this issue is not a fait accompli IMO.
