Or it may be more straight forward...Did one party deceptively withhold material matters, which rightly belonged to both joint venture parties, to gain substantial financial benefits which again rightly should benefit both legal entities of the JV? I am sure the Bench will be mindful of the unfair impact of this if it is proven and the impact of the consequent passage of time on many shareholders. Some may have died or been forced to sell at deflated prices because of the alleged actions of one of the JV parties. Liability may not end with the coming judgement if it goes against Q/H.
