Happy new year to all.
With all the discussion about why FAR think they haven't been notified correctly, don't forget that early on in this saga COP came out and said they had provided all the documentation other than those subject to confidentiality clauses. IMO this is where the dispute lies, what was in the bits not provided. I don't think a confidentiality clause gets them around the requirements of the JV agreement.
