(And yes I see very clearly what is written in the green circle and that this is not about apply for that as a potency assay component its about using it as a functional description or characteristic of what is to constitute an MSC preparation in the context of the patent.


So the claim 1 covers that sort of preparation with ALL of those sort of characteristics - that is what the word AND means. As opposed to say the word OR.

Now would this block say CYP - only if all the conditions were true.

Is CYP ----- bone marrow derived - No

Therefore a) is not true therefore the claim doesn't bear on CYP. All the and conditions would have to be true.
