This is a win!

Let's break it down and keep it simple.

"when asked did the appeal get thrown out....the answer was yes....."

So the COA judges have thrown out the appeal-isn't that what we all were waiting for and wanting to hear?

"the courts asking both parties to reapply (which i believe axiom did instantly) and that the court's will respect the decison of the landowners..."

To my way of thinking "re-apply" means to POSSIBLY re-tender and Axiom have already done-great foresight and clearly is easily done!

Remember that to apply-or re-apply in this instance-you NEED TO HAVE THE LAND OWNERS ON YOUR SIDE. We do!!

If you applied and did not meet the requirements of the application your tender would be rejected.

A re-tender could take days or weeks-so what? We have had SMM appeal dismissed and the judges have pre warned anyone what the outcome would be if they tried to file a suit without landowners on their side.

"the court's will respect the decision of the landowners"

I think that the "market" is starting to digest this information and understand it.

Remember there is no confirmation of a re-tender at the moment.
