    she can’t do that. She is not responsible or able to pass matters into law any more than any other judge. To suggest that she created new laws suggests an imperfect understanding of the way laws are made, the role of judges and the way in which they are required and expected to interpret the law faced with making a judgment.

    any legal system, our own included, relies on case law and precedent. In the US it also draws on the constitution which lays out some fundamental principles which still require interpretation. Many of the things we take for granted now simply didn’t exist when the constitution was written. Same with laws. Few laws are drafted by those houses responsible for their passage into law in a way that is unequivocally clear. It is the judges responsibility to make meaning and apply their experience, intellect and knowledge. There are some very simple principles.

    No judge is any more political than another. They all bring with them a way of viewing the world and their own approach to the law. That is why higher courts have more than one involved in a decision. But you also have a system that unabashedly allows political appointments by either party. There is no doubt that gorusch and that other appointment were political
    wuth a very definite political agenda in mind.

    so if you are going to debase Bader Ginsberg you need to debase them all
