The opening day of the Health Services Union’s long-planned civil trial against former national secretary Kathy Jackson has been thrown into turmoil by news that she has declared bankruptcy.
The hearing is yet to begin, but it is understood Ms Jackson is now listed as an undischarged bankrupt with a trustee appointed for her.
The case is due to begin in Melbourne today before Federal Court judge Richard Tracey, though neither Ms Jackson nor her legal team have attended the court.
The union alleges Ms Jackson spent more than $660,000 on personal expenses, including holidays, shopping and mortgage payments, and $1.07m in separate, unauthorised spending.
Justice Tracey is also expected to rule today on the HSU’s earlier application to freeze Ms Jackson’s assets, including the $1.3m home on the NSW South Coast which she has moved to sell to her partner, Fair Work Commission vice-president Michael Lawler.

Mr Lawler last week hit back at the union’s claim he was not a bona fide purchaser and the sale was a bid to keep the home from the union’s grasp if it won its case for compensation.
