I'm not sure who said KDR never talked with MZN as it was clearly stated that they did and that would necessitate calls, meetings emails etc. The point is that they closed those discussions off and then 6 months later we have the claim. If I understand the gist of yesterdays proceedings it seems KDR's lawyers were stating that actions by MZN do not correlate with what they now allege. I would be making this a point of defence if they are relying on phonemail discussions because you have to show actions after these calls support what you allege was discussed otherwise it's "he said, she said".
If you had rock solid emails confirming the deal then this would be over in MZN's favour.
