yes. it is not a clause of the SOA though but in the Corporations Law and the rules made under it. Once they go best and final there are many hoops and time they need before they can increase the bid unless there is a better one made by another party. Not sure why they went best and final as it just allowed Gina to keep them hanging. A clever lawyer might be able to argue that circumstances have changed enough for them to change course and bid higher now, but not yet IMO. They have to wait a little longer, at least until Gina plays her next card. May not be too long though.
