The link below is just one introduction to AVZ fiduciary duty and disclosure issues. Early 2019, one shareholder determined to clear up uncertainties and ambiguities launched a review on the BNB MOU after learning from a poster giantpaperclip5 here on HC, doubt on SPIC.
What was found was startling. A real hot potato when AVZ was slumping towards 4cps. It was therefore treacherous to sell / dump with liquidity thin and volatile. But when you have knowledge like this and want to sue one must dispose.
Ordinary shareholders have been utterly blindsided about what happened in 2018 because the facts were in Chinese language and silence was maintained because we were all trapped by the share price. Even now it is hard to show how misleading or prove because holders simply don’t want to prove me correct but just wrong.
As a result of conditions in 2019, what was discovered in early 2019, became partly queried publically for first time late 2023. I believe since late December early 2019 and onwards, the matters have been addrsssd to AVZ. We can see from
@Beobachterund he was ignored many times.
Eventually some here some how got a heavily redacted from full view legal letter that likely came from AVZ because my source says his lawyers sent a copy to AVZ directors. That letter outlines breaches of disclosure under Australian laws and a claim for loss. I’ve seen all the docs including a statement of claim. But the statutory time period to litigate was too close or over for a CA law firm to have the time to consider pursuing. There’s also the issue that AVZ didn’t have much cash as we learned in 2024. But the ASIC route remains, and I’m here to share and discover responses to the disclosure issues
my goal here, is to make holders aware when and where possible about the disclosure issues and for their own situation consider a legal strategy other than AVZ’s attempts to recover value in case Kobold etc falls over and ICSID drags
any chance over the statutory time limit. Beyond that I do believe firmly AVZ should be accountable. And that will be done by lodging with ASIC once we are certain every aspect is covered
