I agree with your view ( although I have no legal experience ) .
That said , that won't stop someone taking you to court in the first place to prove your innocence .
There was the very sad case of two kids dying because of a faulty gas heater in Victoria . The court case highlighted the responsibility ( or perceived responsibility ) of testing the household appliances . I think in the end the recommendation was for regular testing but as far as I know it hasn't been implemented as a regulation yet.
Because there were deaths , it took the case to a whole new level .
So my point is , don't assume that you have a good case even though it makes sense to you . The best way is to avoid having to go there in the first place .
