Totally wrong, you've got this completely backwards. It is illegal for the government agency to tell you about a person's past criminal convictions if they are considered "spent" under the legislation. You,as a shareholder, or as a prospective employer, or the ASX, or ASIC, cannot get this information from a government agency (There are a few rare exceptions: for example a court or a police investigation is able to access records of all prior convictions).

Nope, totally wrong again. It is indeed about what the government agency is allowed to disclose; that is the precise point of the legislation.
