Here is the Hartley's take on Day 1 of the court case:

We attended the public gallery of the KDR/MZN court case in Western Australia’s Supreme court yesterday.
Most of the morning was taken up with MZN lawyer Martin Bennett opening remarks with KDR’s lawyer Grant Donaldson only taking a few minutes for his opening remarks.
When Joe Treacy (MZN MD) was cross examined by Grant Donaldson ( KDR lawyer) and asked why he has not paid the shares or cash to KDR his response was that the discussion broke down before that could be done.
The draft Heads of Agreement (HOA) was conditional on KDR actually having the Mt Holland tenements in their name but at the time (4th April) 24 of the tenements in the agreement were not in KDR's name.
The Head of Agreement was never finalised by the parties and therefore not signed by KDR.
In the records of MZN board meeting minutes there is no mention of KDR agreement until the 10th of October board meeting where it mentions that they will seek further legal advice regarding the matter.
Anthon Eaton (MZN lawyer at the time of the alleged transaction) agreed that the HOA had not been executed and was dependent on 3 or 4 more agreements such as the net smelter royalty.
Martin Donohue (KDR MD) is due to be cross examined first thing this morning (10:15AM WST).
