Under what theory would courts rule to return the licences
The Cameroon convention had already expired and surely Congo will argue that they could see no prospect of SDL attracting development capital. Don't forget SDL stated that they had never done a feasibility on developing Congo as a stand alone so losing Cameroon would mean they would basically have to start again with Congo and these appear to be separate actions with each country!!
It appears much more likely the only avenue they have is to seek compensation for costs incurred, particularly in regard Congo. No doubt they will argue that they are also entitled to compensation from Cameroon due to how this has apparently played out and promises from the Cam Gov, but end of the day SDL won't be able to show a way forward.
Doubt if either Country will eventually pay anything. It appears more likely that there will be a contingency fund set up by the new developers which will pay any compensation awarded, however difficult to see much of this trickling down to shareholders.
But who knows, the above is just my opinion..................
