This is an ambit (spurious) claim. The lawyer can attempt to charge the doctor for advice, but since the doctor did not agree to receive advice for payment, the doctor is entitled to ignore the claim.
The lawyer since he is professionally trained to be devious may complain and make a scene but he will not win even in a court.
Elements in a contract are:
1. First party offers a service or item
2. Other party accepts the offer
3. A consideration (deposit) is paid
4. Both parties show clear and well understood and unambiguous intent
5. Lack of over-hanging conditions.
